Terms and Conditions

This document covers all of Infant Parent Health Alliance Ltd (IPHA) products and services, inclusive of, but not limited to: IPHA Certification, Parent classes, masterclasses, consultations, webinars, books, videos, courses, website and blog information and any other content or materials provided by IPHA Ltd.

For the purpose of simplicity, the use of Infant Parent Health Alliance Ltd, or IPHA within these terms and conditions also includes “Philippa Murphy", "i", “we”, “us”, or “our” and the registered trading names of "Murphy Media", "Nurture with Nature” and "BabyCues Ltd.”

By using any information, or purchasing any of the IPHA products or services, you agree to the following terms outlined in this agreement as a condition of your purchase and undertaking of any material used.

1. Terms

By accessing, or undertaking IPHA training, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws of New Zealand. If you do not agree with any of these terms, you are prohibited from using or accessing any products or services of IPHA Ltd. The materials contained in the IPHA training, and through IPHA Ltd are protected by applicable copyright and trademark law.

2. Use License

Permission is granted for each student to temporarily download one copy of any downloadable materials supplied for the IPHA Training for the purpose of personal, non-commercial transitory viewing for training only. This is the grant of a license, not a transfer of title, and under this license you may not:

  1. modify or copy the materials;
  2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  3. attempt to decompile or reverse engineer any software contained on IPHA website, or within any third-party programmes used within the training website;
  4. remove any copyright or other proprietary notations from the materials; or
  5. transfer the materials to another person or 'mirror' the materials on any other server

Use of materials for companies, organisations or governmental services will be at the discretion of IPHA Ltd and agreed upon in writing and individually with the following terms and conditions as standard. You may not:

  1. modify or copy the materials
  2. use the materials for any commercial purpose
  3. attempt to decompile or reverse engineer any software contained on IPHA website, or within any third-party programmes used within the training website;
  4. remove any copyright or other proprietary notations from the materials; or
  5. No replication of IPHA Ltd materials or products, either printed, or on any other server is to be carried out unless agreed upon on in writing. 

You must:

  1. ask for permission from IPHA, or have been granted permission to use or share any material, product, service or teaching of IPHA Ltd
  2. include a link to https://iphalliance.com (the IPHA Ltd website) when mentioning or sharing any material, product, service or teaching that IPHA Ltd provides.

You agree:

  1. IPHA Ltd and aforementioned subsidiaries are granted permission by you to use your logo on their websites or any written material, so the public know where they can go for further help; and IPHA Ltd will link to your website wherever possible.
  2. All staff/students that attend the training will complete a multiple-choice test within two weeks of training, and with a pass rate of 70%, they will receive a CPD accredited Certification of their chosen training. 
  3. All staff/students that attend training will complete a IPHA Evaluation Survey with all responses being able to be used by IPHA Ltd.

This license shall automatically terminate, or be terminated, if you violate any of these restrictions. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.


3. Disclaimer

The materials used in IPHA Ltd, on the website or through any third-party provider, are provided 'as is'. IPHA Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, IPHA does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website, training, or otherwise. In addition, IPHA Ltd does not guarantee that use of our websites will be free from technological difficulties including, but not limited to, unavailability of information, downtime, service disruptions, viruses, or worms. You understand that you are responsible for implementing sufficient procedures and checkpoints to satisfy your requirements for accuracy or data input and output.

Users should always consult with a qualified and licensed physician or relevant medical care provider.
IPHA website, blog and all services are provided in line with educational information rather than from a medical background

Reliance on any content is solely at the user's risk.

Content by Philippa Murphy, trading as IPHA Ltd and Murphy Media may contain health or medically related materials considered sexually explicit to some. Users are warned that if they may be offended by such content, an alternate source of information should be found and responsibility for locating an alternate source of information lies with the User.

4. Limitations

In no event shall IPHA Ltd be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or any other monetary or other damages, feeds, fines, penalties, or liabilities arising out of or relating in any way to this service or sites accessed through this service, and/or content or information provided herein. Any claims against IPHA Ltd liability related to a product or service purchased through us, whether on our website or otherwise, is limited to the amount you paid for the product or service. Your sole and exclusive remedy for dissatisfaction with the service or training is to stop using it. We are however aware that some laws around the world do not allow the exclusion or limitation or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

5. Fees and payment

By purchasing any of the IPHA products and services, you agree to:

  1. Pay the advertised price in your currency, and where applicable, it is your responsibility to check the equivalent in your local currency.
  2. All purchases made will be quoted in your currency or USD if your currency is not possible.
  3. Your payment will be processed through PayPal, Stripe, or eWAY Payment Gateway. All of these third-party providers secure all your customer and credit-card data with military-grade software and servers, and the highest level of encryption available. IPHA Limited will not store or transfer any of your credit card information. All data is transferred using the third-party secure servers.
  4. We do not retain credit card details provided during payment and your information is managed by the Privacy Policy of the third-party payment processor selected by you for payment. We do however retain transaction record information for future reference which does include a partial credit card number to assist with purchase enquiries.
  5. We reserve the right to change these prices from time to time. Please check the website for updated pricing information.
  6. Due to the nature of the delivery of all IPHA services, no refund is available for change of mind, or not being able to attend on the date of training.
  7. A refund may be considered where there is a breach of consumer guarantees under The Consumer Guarantees Act (CGA) of New Zealand. Any request for a refund for any such breach must be in writing to support@iphaalliance.com

6. Your responsibilities

  1. You agree that you must complete any webinars, books or course you have purchased to obtain the full benefit of them.
  2. You agree that you are fully responsible for your progress and results from any service you have purchased from IPHA Ltd.
  3. You agree that individual results may vary and that it is possible that you may not achieve the expected results and that you’re learning and outcome is dependent upon your commitment to completion and personal skills and abilities and not the responsibility of IPHA Ltd.

7. Complaints Procedure

  1. As a consumer you have the right to complain under The Code of Health and Disability Services Consumers' Rights (the Code) which establishes the rights of consumers, and the obligations and duties of providers to comply with the Code. You also have the right to contact the Health and Disability Commissioner.
  2. As per the Code, IPHA Ltd will facilitate the fair, simple, speedy, and efficient resolution of complaints. As the provider within this service, Philippa Murphy, trading as IPHA Ltd will acknowledge receipt of the complaint, in writing, within 5 working days, unless resolved prior to this. All actions on the complaint will be documented and the consumer will receive all information held by IPHA Ltd that is or may be relevant to the complaint. Within ten working days of giving written acknowledgement of a complaint IPHA Ltd will decide whether the complaint is justified, or does not accept that the complaint is justified, or extend the time required to investigate the complaint, informing the consumer and providing reasons for this. Otherwise the consumer will be informed about their complaint within one month of receiving. The response would include whether IPHA Ltd accepts the complaint as being justified, the reasons for the decision, actions taken by IPHA Ltd, any appeal procedure the provider has in place.

8. Revisions and Errata

Although every effort is made to ensure the accuracy of published information with IPHA service and products, the materials appearing on IPHA Ltd websites and materials may include technical, typographical, or photographic errors. IPHA Ltd do not warrant that any of the materials on its web site are accurate, complete, or current. We may make changes to the materials contained on its web site at any time without notice. IPHA does not, however, make any commitment to update the materials.

9. Links

IPHA Ltd is not responsible for the contents of any linked sites on our websites or in our materials. The inclusion of any link does not imply endorsement by IPHA Ltd. Use of any such linked website is at the user's own risk.

10. Modifications

IPHA Ltd may revise these Terms of Use at any time without notice. By using IPHA products and services you are agreeing to be bound by the then current version of these Terms of Use.

11. Governing Law

Any claim relating to IPHA Ltd shall be governed by the laws of IPHA home jurisdiction without regard to its conflict of law provisions.
